Terms and Conditions

These Terms and Conditions ("Terms") govern your access to and use of the Kurbside mobile application, website and related services ("Kurbside"). Kurbside is operated by Sepehr Kashani Nejad in Melbourne, Australia ("we", "us" or "our").
By downloading, accessing or using Kurbside, you agree to these Terms. If you do not agree, do not use Kurbside. Any mandatory terms imposed by the app marketplace through which you obtained Kurbside also apply.
1. What Kurbside provides
Kurbside is a household bin-collection information and reminder service for supported Australian council areas. Depending on availability, Kurbside may let you:
- search for and save a residential property;
- identify a supported council and collection area;
- view upcoming household bin collections; and
- schedule local reminders on a compatible device.
Supported councils, bin types and features may change over time. Kurbside is an independent service and is not an official council service or endorsed by any council unless expressly stated.
2. Eligibility and residential use
You may use Kurbside only if you can lawfully agree to these Terms. The address lookup is intended for residential properties in supported areas. Business, apartment, private or newly created properties may use different waste services and may not be supported.
3. Licence
Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable and revocable licence to use Kurbside for your own lawful, non-commercial household purposes. Kurbside and its software, design, branding and original content remain owned by us or our licensors.
4. Your responsibilities
You are responsible for:
- selecting the correct address and checking the identified council;
- keeping your saved property and reminder preferences current;
- maintaining a compatible device with the correct date and time;
- allowing notifications if you want reminders;
- checking official council instructions when timing is important; and
- placing and using bins in accordance with council rules.
5. Collection information
Collection information is obtained from councils, council contractors, public datasets and third-party address or mapping services. These sources may be unavailable, delayed, incomplete or incorrect and may change schedules for public holidays, emergencies, service disruptions or individual properties.
We take reasonable steps to present available information accurately, but Kurbside is a convenience tool and not the authoritative source for waste services. You should confirm unusual, important or conflicting information directly with your council. A result for one property should not be assumed to apply to another property.
6. Reminders and device permissions
Kurbside reminders are currently scheduled locally on your device. Delivery depends on your device, operating system, notification permissions, battery settings, date and time settings, and whether a future collection was successfully loaded. We cannot guarantee that a reminder will be displayed at a particular time.
Location access is optional and is requested only to help determine your current address. You may enter an address manually. You can change location and notification permissions in your device settings.
7. Acceptable use
You must not:
- use Kurbside unlawfully or to infringe another person's rights;
- attempt to gain unauthorised access to Kurbside, its API or infrastructure;
- interfere with the service or bypass technical or security restrictions;
- use automated requests, scraping or excessive traffic that could disrupt Kurbside or a council service;
- reverse engineer Kurbside except where applicable law expressly permits it; or
- misrepresent your relationship with Kurbside or a council.
8. Third-party services
Kurbside relies on services operated by third parties, including Google Places, device-platform services, council systems, database providers and hosting providers. Your use of those services may also be subject to their terms and privacy policies. When you use Google-powered address features, you also agree to the Google Maps/Google Earth Additional Terms of Service.
We do not control third-party services and are not responsible for changes, outages or content supplied by them, except to the extent responsibility cannot lawfully be excluded.
9. Privacy
Our Privacy Policy explains how Kurbside handles information and is incorporated into these Terms by reference.
10. Availability and changes
We may maintain, modify, suspend or discontinue any part of Kurbside, add or remove supported councils, or introduce limits where reasonably necessary. We do not promise that Kurbside will always be available, error-free or compatible with every device. Where practical, we will try to communicate material changes.
11. Australian Consumer Law
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy under the Australian Consumer Law or another law that cannot lawfully be excluded, restricted or modified.
12. Disclaimers and liability
To the extent permitted by law, Kurbside is provided on an "as available" basis. We do not make guarantees beyond those that cannot lawfully be excluded, including guarantees that council data will always be current or that a notification will always be delivered.
To the extent permitted by law, we are not liable for indirect, incidental or consequential loss arising from unavailable or inaccurate third-party collection information, a missed notification, device settings, or use of Kurbside contrary to these Terms. This limitation does not apply to liability that cannot lawfully be excluded or limited.
13. Suspension or termination
You may stop using Kurbside at any time and uninstall the app. We may restrict or terminate access where reasonably necessary to address unlawful use, abuse, security risk or material breach of these Terms. Provisions that by their nature should continue after termination—including intellectual property, disclaimers and applicable limitations of liability—will survive.
14. Changes to these Terms
We may update these Terms to reflect changes to Kurbside, its providers or applicable law. Updated Terms will be published on this page with a new "Last updated" date. If a change is material, we may also provide notice in the app or through another reasonable channel. Continuing to use Kurbside after updated Terms take effect means you accept them.
15. Governing law
These Terms are governed by the laws of Victoria, Australia. You and we submit to the courts having jurisdiction in Victoria and any courts entitled to hear appeals from them, without limiting any rights you have under applicable consumer law.
16. General
If part of these Terms is invalid or unenforceable, it will be read down to the extent necessary or severed, and the remaining provisions will continue. A delay in enforcing a right is not a waiver of that right. You may not transfer your rights under these Terms without our consent; we may transfer ours as part of a legitimate transfer of Kurbside, subject to applicable law.
